Title 40.1-51.1,(a),Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that: (a) Accessible areas within the swing radius of the rotating superstructure of the 942 Liebherr Hydraulic Excavator that was located on the barge had not been barricaded to prevent employees from being struck or crushed by the Hydraulic Excavator. One feasible and acceptable method, among others to correct this hazard is to adhere to 1926.550(a)(9): "Accessible areas within the swing radius of the rear of the rotating superstructure of the crane, either permanently or temporarily mounted shall be barricaded in such a manner as to prevent an employee from being struck or crushed by the crane."
