North Carolina General Statute 95-129 (1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: hazards associated with fire in a confined space, including but not limited to: second and third degree skin burns. a)Cary Water Tower work site- where a Graco airless paint pump (part number 263-477, series L95A) was used to spray paint flammables (including, but not limited to: butanol,xylene, hexone, and ethyl benzene) without being electrically grounded in accordance with the manufacturer's operations manual. One feasible and acceptable abatement method to correct this hazard is to use the grounding wire on the paint pump that is supplied by the manufacturer and perform weekly testing of the electrical resistance of the fluid hoses.
