General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught between moving trucks and/or machinery: a) At Weld County Rd 47 and Highway 52, Hudson, CO. (Don Ward & Co. jobsite): Employees engaged in the loading of semi trucks from rail cars were exposed to crushing hazards. In that while placing the skirting of the auger in the truck hatch they could be caught between the truck and the auger head. Among other methods, one feasible and acceptable abatement method to correct would be to perform a site hazard analysis and then implement a site specific safety plan. This plan would cover the areas of assigned responsibilities, standardized signals, procedures, and nay other pertinent concern. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
