Section 5 (a)(1) of the Occupation Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a. On or about June 12, 1998, at the job site located at 87th and
Harlem, Bridgeview, IL, two employees working in separate aerial
lifts were not wearing a harness and lanyard to prevent falling out
of the basket to the ground.
b. On or about June 12, 1998, at the jobsite located at 87th and
Harlem, Bridgeview, IL, two employees working in separate aerial
lifts were standing on the mid and top rails of the lifts to
complete work.
A feasible and useful means of abatement includes, but is not
limited to the following action:
1. Ensure that all employees who work in an aerial lift maintain a
firm footing on the platform while working thereon and use a safety
harness and lanyard which is correctly donned and used according to
the manufacturers' recommendations.
