NCGS 95-129(1) of the Occupational Safety and Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to:  falls
a)6132 Highway 64 E., Citgo Gas Station Canopy Project. -
Steel I beam was hoisted whit an employee sitting on
it.
Reference: ANSI B30.5 -Article 5-3.2.3(e) "The operator shall not
hoist, swing, travel while anyone is on the load or hook."
One feasible and acceptable abatement method, among others, to
correct this hazard is to assure that the load is not hoisted,
lowered, swung, or traveled while an individual is on top as
stipulated by ANSI B30.5 -1968 Chapter 5-3, Section 5-3.2,
Article 5-3.2.3(e)
