N.C.G.S. 95-129(1): The employer, Mr. Ken Bateman, the crew leader, Mr. George Moore III, The manager, Mr. James "Jack Rabbit" Fagans, and the owner, Mr. T. F. Parsons did not furnish to each employee conditions of employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to: a) hanging toggle switch which had 120 volts electrical current near a direct to ground in the form of a cast iron bath tub located in a white migrant house with blue trim.
