Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from steel shelving units and/or its contents: a) Warehouse, Row 45, Bin 37 - Employees are working in a warehouse where steel shelving units are damaged (severly bent or twisted). The damaged storage racks were allowed to maintain merchandise, thus exposing employees to physical injuries. Among other methods, one feasible and acceptable method to correct this hazard is: (1) Develop and implement a structural integrity program to periodically inspect the storage racks as recommended by the Rack Manufacturers Institute Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks 1990 Edition, Sections 1.4.1.29 CFR 1903.19(d)(1) which requires certification and documentation that the abatement of the above violation is complete. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
