North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to hazard(s) of being struck by falling
object or debris/caught in/under/between object:
a)jobsite - employer supplied and/or allowed use of
inadequate or inappropriate equipment (steel chain; Grade
43 high test carbon steel; intended use for tie-down
purpose), that was used by employees of sub-contract
company for lifting 90 x 94 inch concrete pad
(approximate weight 5600 - 5800 pounds).
One feasible and acceptable method to abate this hazard would be to
replace the high test chain with grade 8 alloy steel chain approved
for lifting.

North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to struck by/crush by hazards:
a)jobsite - employer supplied and allowed use of
inadequate, or inappropriate rigging and lifting
equipment (5/8 inch regular eyebolts embedded in concrete
pad; used in conjunction with 38 inch length, Grade 43
high test carbon steel chain) used to lift 90 x 94 inch
concrete transformer pad. Employee(s) were exposed to
overhead hazard created by suspended load (5600 - 5800
lbs) due to improper lifting & handling and inadequate
rigging & lifting equipment. The maximum working load
limit of eyebolt(s) was exceeded by 400 to 600 pounds,
due to angular lifting of transformer pad. Hazard
condition resulted in fatal injury to one employee when
struck by falling load on 09/16/98.
One feasible and acceptable method, among others, to correct this
hazard is to assure that equipment to be used is tested and
approved for use by ASTM 413/A 413M-96, Chapter 9, Table 2.
