North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees, in that employees were exposed to falls in excess of 25
feet:
a)falling to lower elevation - employees were allowed to
use a Snorkel Economy, model 5000, scissor-lift, that had
a damaged mid-rail on its front side and its chain
midrail was not in place at its opening.
One feasible and acceptable abatement method, among
others, to correct this hazard is to repair the damaged
midrail and connect the chain midrail at its opening.
