Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
the hazard of being struck by a fire hose which was lying unprotected
across the roadway and
subject to vehicular damage.
Among other methods, one feasible and acceptable method to correct the
hazard is: 1) Obtain
a permit to use the fire hydrant and install the meter as required. 2)
Protect the hose from
vehicular damage by covering it or re-routing traffic. In either case, a
properly attired flag
person should direct traffic.
