Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to :
(a)4/13/99, an employee was observed driving a TCM FD70 forklift (Model
FD70Z1; Serial No. 57804135) to  transport septic tanks and dry wells
without
using the seat belt or restraint device provided on the forklift truck,
thereby
exposing the employee to serious injury to the operator's head and/or
torso in the
event of a rollover.
ABATEMENT: One feasible means of abatement, among others, is to enforce
the usage of seat
belts on all forklifts equipped with them.
ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM.
