Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees in that employees were working in a
self propelled
extensible boom aerial lift and were not utilizing an appropriate fall
arrest system.
Employees using aerial lifts at the Elgin gravel pit jobsite were exposed
to fall hazards.
Fall protection was not utilized.
A feasible method of abatement would be to insure that employees wear
appropriate fall
protection as required.
Among feasible means of abatement would be to comply with the American
National Standards
Institute, ANSI A92.5-1992 Standard for Boom-supported Elevating Work
Platforms and,
1.    Have the employee wear fall arrest anytime that they are in the
aerial lift.
