Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazard and crushing injury while riding
in the bucket of a
backhoe:
(a) At 201 Central Ave., West, Lake Wales, FL 33859, the Lake Wales
Municipal Complex,
northside of the firehouse located on the northwest corner of the property
- An employee
operating a Ford backhoe lifted material and employee together in the
front bucket to the
second floor.  Employee was steadying material and was exposed to a fall
hazard of 14 feet
to the ground and a crushing hazard of the material shifting, on or about
8/31/99.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to prohibit the bucket from being used as a personnel carrier, work
platform or a mode of
transportation for employees.  Follow the instruction from the
manufacturers operating
manual and the requirements of the Farm and Industrial Equipment
Institute, aka Equipment
Manufacturers Institute, that prohibit this practice.
