Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a) The hazard of falling into the elevator hoistway, or being crushed by
the moving elevator
car in the warehouse on or about 13 November 2000 and at times prior
thereto.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to bring the elevator in to compliance with all applicable sections of
the American National
Standards Institute (ANSI) A17.1 Elevator standards which include, but are
not limited to the
following:
1. All hoistway entrances must be provided with hoistway doors or gates
which guard the
full width of the hoistway to a height of at least 6 feet.  The hoistway
doors or gates must be
provided with mechanical locks and electrical controls or with interlocks
which will prevent
movement of the car unless all doors or gates are in a closed position and
will prevent the
doors or gates from being opened from the hoistway side unless the car is
at a landing.
2. The elevator car must be provided with a car door or gate which guards
the full width of
the car to a height of at least 6 feet.  The car door or gate must be
provided with an
electrical contact that will prevent the operation of the elevator unless
the door or gate is in
the closed position.
3. The elevator car, with the exception of the entrances, must be enclosed
on all sides to a
height of 6 feet with fixed walls attached to the car platform and which
are designed to keep
materials and personnel from extending outside the car.
4. The chain hoist system must be replaced with a wire rope hoisting
mechanism powered by
an approved elevator Driving Machine.
5. The elevator car must be provided with electric lighting which also
provides emergency
light incase of electrical power failure.
6. The elevator car must be provided with a car safety device of a type
which is proper for
the car's speed and operational design.  This car safety must be provided
with a switch
which, when operated, will remove power to the elevator before of at the
time the safety is
applied.  The car safety device must be activated by a speed governor.
7. The elevator's winding drum must have a final terminal stopping switch
located in the
hoistway and operated by cams attached to the car.
8. An emergency stop switch that is manually operated, red in color, and
conspicuously
marked "STOP" must be provided in the elevator car adjacent to the
operating
controls.
9. A capacity plate and data plate are required on every elevator and
shall be securelyfastened in place.  Additionally signs shall specify the
type of loading for which the elevator
is designed and whether or not passengers are permitted.
10. Upper and lower normal terminal stopping devices shall be provided and
arranged to
slow down and stop the elevator car automatically, at or near the top or
bottom terminal
landings, with any load up to and including rated load, and from any speed
attained in
normal operation.  Such devices shall function independently of the
operation of the
operating device and of the final terminal stopping device.  The upper and
lower normal
terminal stopping devices shall be so designed and installed that they
will continue to
function until the final terminal stopping device operates.
11. A preventive maintenance program must be established which includes
regular
inspections by a trained professional elevator inspector.
