Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to asphyxiation by carbon dioxide:
a)In the second sub-level floor vault at 55 Water Street
On or about July 27, 2000.
Employees were not aware of the hazards, the alarm signal nor the safe
evacuation of the vault area which was protected by a carbon dioxide fire
suppression system.  There were no warning signs, pre-discharge alarm and
training.
Among others, feasible abatement means are:
As per NFPA 12, 1973 edition, section 12.122 In any proposed use of carbon
dioxide where
there is a possibility that men may be trapped in, or enter into
atmosphere
made hazardous by
carbon dioxide discharge, suitable safeguards shall be provided to insure
prompt evacuation of
and to prevent entry into such atmosphere and also to provide means for
prompt rescue of
trapped personnel.  Such safety items as personnel training, warning
signs, discharge alarms,
pre-discharge alarms and breathing apparatus shall be considered.
As per NFPA 12, 1993 edition section 1-5.1.1 In any use of carbon dioxide,
consideration shall
be given to the possibility that personnel could be trapped in or enter
into an atmosphere made
hazardous by a carbon dioxide discharge.  Suitable safeguards shall be
provided to ensure
prompt evacuation, to prevent entry into such atmospheres and to provide
means for prompt
rescue of trapped personnel.  Personnel training shall be provided.
Pre-discharge alarms shall
be provided except as noted in 1-7.1(c) and 1-7.3.5.
As per NFPA 12, 2000 edition, section  1-6.1.1 In any use of carbon
dioxide, consideration
shall be given to the possibility that personnel could be trapped in or
enter into an atmosphere
made hazardous by a carbon dioxide discharge.  Suitable safeguards shall
be provided to ensure
prompt evacuation, to prevent entry into such atmospheres and to provide
means for prompt
rescue of trapped personnel.  Personnel training shall be provided.
Pre-discharge alarms shall
be provided except as noted in 1-8.1(c) and 1-8.3.5.

The manual activation device was not identified as to the hazards to the
employees.  Two manual activation devices located in the vault area
observed as
a red activation switch labeled "Fire", "Pull".

As per NFPA 12, 1973 edition, section 12.1439 All manual operating devices
shall be identified
as to the hazard they protect.
As per NFPA 12, 1993 edition, section 1-5.1.2 Appropriate warning signs
shall be placed at
every location where manual operation of the system may occur.  A typical
sign at each manual
actuation station: WARNING ACTUATION OF THIS DEVICE WILL CAUSE CARBON
DIOXIDE TO DISCHARGE.  BEFORE ACTUATING, BE SURE PERSONNEL ARE CLEAR
OF THE AREA.
As per NFPA 12, 1993 edition, section 1-7.3.9 All manual operating devices
shall be identified
as to the hazard they protect, the function they perform, and the method
of operation.
As per NFPA 12, 2000 edition, section 1-6.1.2.2 Appropriate warning signs
shall be placed at
every location where manual operation of the system can occur.  A typical
sign at each manual
actuation station is as follows: ACTUATION OF THIS DEVICE WILL CAUSE CARBON
DIOXIDE TO DISCHARGE.  BEFORE ACTUATING, BE SURE PERSONNEL ARE CLEAR
OF THE AREA.
As per NFPA 12, 2000 edition, section 1-8.3.9 All manual operating devices

as to the hazard they protect, the function they perform, and their method
of operation.
