North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)Watershed Road -- the employer did not follow the
industry standard for testing water lines on July 30,
1999, when a Town of Mars Hill employee was killed when
he was struck by a reducer which was blown from the water
line by air pressure.
Among other methods, one feasible and acceptable method
to correct this hazard is to instruct all employees to
never use air pressure in a water line and to enforce
this instruction.
