Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)Employees were exposed to hazards created by the use of elevated work platforms which were not designated, constructed and/or used in accordance with the acceptable requirements of the American National Safety Standard for Rough Terrain Forklift Trucks, ASME/ANSI B56.6-1992 (with Addenda 56.6a in 1994). For example: the personnel platform did not meet the design requirements of that standard in the following area: Section 5.15.1, a rough terrain truck should not be used to lift people unless there is no other practical option. If a rough terrain truck must be used to lift people, the following precaution (among many) for the protection must be taken - (j) Be certain that the rough terrain forklift truck has firm footing; (q) Always lower the platform if you must move the rough terrain truck for adjustments in positioning. The above conditions were observed to exist on May 22, 2000 at the construction worksite located at 5050 West Bradley, in Milwaukee, WI., which involved a Rough Terrain Forklift Truck. The platform was being used to elevate a worker to perform carpentry functions on an entrance-way. Among other methods, one feasible and acceptable means to correct these hazards is to assure that the design, manufacture, and use of all attachments for Rough Terrain Forklift Trucks are in accordance with the most current American National Standard, B56.6-1992, and/or has the prior approval of the lift truck manufacturer. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
