Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)The General Contractor was aware that the sub-contractor was at various
locations while installing, moving, and dismantling masonry tower
scaffolding. An employee was elevated in a damaged personnel lifting
platform by an all terrain fork lift which was not designed for elevating
personnel.  This exposed the employee to a fall greater than 30 feet.
By following the ANSI B 56.6-1992 Chapter 5 Items (a) through (y), this
condition could have been avoided.
No certification required.  Violation Abated.on
