North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a vehicle- mounted rotating aerial device without complete and documented maintenance and inspection records [Reference ANSI/SIA A92.2-1990, Section 8.3]: a)site, 452 Phelps Road, Louisburg, NC - for an employee conducting line- clearance tree-trimming operations from the bucket of a Lift-All model LAOC51- 1S rotating aerial device (serial number 1724128751OC) mounted on a 1996 Ford F Series truck (VIN# 1FDXF8OC3VVA35689), and two ground crew employees working in the vicinity of the boom. ABATEMENT NOTE: The Operational, Maintenance, and Parts Manual for the Lift-All Series LOAC contains a brief inspection check list and a detailed maintenance schedule. These two sections could be used to produce one or more inspection lists that could be used by the maintenance and/or line clearance crews to ensure the proper operation of the Lift-All aerial devices.
