Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling to the ground while working from an
unsecured,
"homemade platform" lacking guardrails, which was raised in the air by the
forks of a powered
industrial truck:
a)  Country Inn & Suites construction site on W. Henrietta Rd., Henrietta,
NY - On or
about 3/23/00, two employees were exposed to falls of approximately 10
feet while
working from a platform supported in the raised position by the forks of a
powered
industrial truck.  The workplatform lacked guardrails, was not secured to
the truck, and
was not of substantial construction.
Among others, a feasible method to eliminate or materially reduce this
hazard
is to:
1. Provide a properly engineered "cage" type workplatform with guardrails
installed, and
securely fasten it to the carriage of the forklift truck as required by
Sections 4.17 and
7.35 of ASME B56.1-1993.
