Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls:
a) An employee working from an homemade personnel platform was exposed to
falls
when the personnel basket was missing a midrail. The American National
Standards Institute,
ANSI 92.5 paragraph 4.11.2 requires that all platforms be constructed with
a guardrail system.
Among other feasible and useful methods of abatement, one method would be
to install a
platform approved by the manufacturer and equipped with standard guardrail
system including
a top rail at 42 inches in height and midrail with a toeboard.
