Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard of approximately 20 to 25 feet:
a)Construction Site, 488 River Road, Warren, PA - Employer used the
bucket of a John Deere excavator, serial #CK490DS014595, to lift an
employee near overhead energized high voltage power lines. Employee did
not have any fall protection and was knocked out of the bucket by the high
voltage line. Employee fell approximately 20 to 25 feet.
Among other feasible and acceptable methods to correct this hazard are to:
1)Follow instructions in Safety Manual for Hydraulic Excavators published
by
Construction Industry Manaufacturers Association (CIMA) that states "Never
allow anyone to
ride the attachment or the load. This is an extremely dangerous practice."
2)Use proper aerial lift to lift employees to different heights.
