North Carolina General Statute 95-129(01) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish to each of his employees conditions of employment and a
place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees:
a)jobsite, Lot #53, Marett Court, front of house under
construction -- forks of powered industrial truck being
used for access to and egress from scaffold.
NOTE: Among other methods, one feasible and acceptable method
to abate this hazard is to provide and utilize a ladder or a
personnel cage which is designed to be utilized on a fork
lift.
