Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to stuck-by and crushed-by injuries from the special purpose
elevator:
Employees working on the ground level, south of the truck dump, of the
grain elevator
were exposed to struck-by hazards in that the special purpose elevator car
did not have
barricades to prevent entry into the car landing area.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to enclose the area around the special purpose elevator and
place a door that
is as high as the special purpose elevator car or 7 feet whichever is
less, as required by
the American Society of Mechanical Engineers in Safety Code for Elevators
and
Escalators, ASME A17.1-1996, Rule 1500.6a Hoistway Doors and Gates.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is complete.
