North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: (Ref: North Carolina Commercial Driver's Manual, Version 2.0, pages 5-10 & 5-11) a)Facility - a commercial dump truck was parked and left unattended without the parking brake set on the incline outside the office which resulted in a fatality on July 7, 2000. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a posted "No Parking or Stopping" zone that encompasses the sloped portion of the driveway, outside the office, and initiate a program where company management personnel perform spot checks of parked vehicles to ensure drivers are complying with requirements to set parking brakes.
