North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) on the construction site, an employee was permitted to ride the forks of a powered industrial fork truck, which resulted in a fall (11/13/00). Ref: ANSI B56.1 - 1969, Section 602 (C) NOTE: Among other methods, the feasible and acceptable method to abate this hazard is to (1) prevent employees from positioning themselves on the forks. b)on the construction site, an employee was observed working from a personnel basket which was not secured to the forktruck. NOTE: Among other methods, the feasible and acceptable method to abate this hazards is to (1) secure the basket to the forktruck.
