North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a) on the construction site, an employee was permitted to
ride the forks of a powered industrial fork truck, which
resulted in a fall (11/13/00).

NOTE:  Among other methods, the feasible and acceptable
method to abate this hazard is to (1) prevent employees
from positioning themselves on the forks.
