Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees in that employees were working in a
self propelled
extendible boom aerial lift and were not utilizing an appropriate fall
arrest system.
At light pole E-1 on the north side of Charlestown Mall, St. Charles, IL,
an employee was
working in an articulating boom manlift approximately 65 feet above the
ground and was not
wearing an appropriate fall arrest system as specified in ANSI A92.5-1980
Section 13.2.6 as
wellas in the Operator's Manual.
A feasible means of abatement would be to insure that employees wear
appropriate fall
protection as required.
