Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to being struck by the rotating counterweight of an excavator: Job Site: Inside Foundation. Employees were exposed to being struck by the rotating counterweight of a Caterpiller 330 excavator where there was no swing radius protection utilized. One method of abatement, among others would be to erect a barrier around the area of swing radius to prevent employees from entering the danger zone.r
