Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of being struck by a Smith swing beam hoist used for lifting gravel to the roof deck at 903 Dundee Road, Wheeling, Illinois, when the hoist was not equipped with proper counterweight materials. Among others, one feasible and acceptable method of abatement is to use approved counterweight materials specified by the hoist manufacturer. No abatement documentation required for this item.
