Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: The hazard of being caught in/by the rotating PTO drive shaft and cutting blades of a mower deck, in the event the operator were thrown from the operators seat of the mower since the Operator-Presence Switches on six TORO Mowers were not functioning. (a) Keesler AFB, Mississippi - Employees were not protected from being caught in/by the PTO drive shaft and cutting blades of the mower deck. The employees were operating five TORO - Groundsmaster 325-D and one TORO - Z-Master 255 mowers that did not have functioning "Operator-Presence Controls" that would stop the drive shaft and blades in the event the employees were thrown from the operators seat of the mower. Among others, one feasible and useful abatement method to correct this hazard is to: (1) Follow the requirements of the Operator's Manual for the TORO, GOUNDSMASTER 325-D. Safety Instructions, Page 4, "BEFORE OPERATING", Item #7 states, "Check interlock switches daily for proper operation (Refer To Checking Interlock Switches, Page 23). Do not rely entirely on safety switches - shut off engine before getting off seat. If a switch fails, replace it before operating the machine".

Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: The hazard of being struck by a mower or from the mower rolling over a bank due to non functioning brakes. (a) Keesler AFB, Mississippi - Employees were not protected from being struck by the mower or from the mower rolling over a bank. The employees were operating five TORO - Groundsmaster 325-D and one TORO - Z-Master 255 mowers that did not have functioning brakes or parking brakes that would stop the mower and prevent employees from being struck by the mower or prevent the mower from rolling over a bank. Among others, one feasible and useful abatement method to correct this hazard is to: (1) Follow the requirements of the Operator's Manual for the TORO, GOUNDSMASTER 325-D. Page 19, Controls, "Brake Pedal" reads "Whenever the engine is shut off, the parking brake must be engaged to prevent accidental movement of the machine". (2) The American National Standards Institute's standard for Commercial Turf Care Equipment, ANSI/OPEI B71.4-1990 at section 6.4.2, Service Brakes, states "A means shall be provided to stop the machines motion in both forward and reverse directions......". Section 6.4.3, Parking Brakes, 6.4.3.1.1, 'A means shall be provided to park a machine in any direction.....".
