Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by hazards in that a two inch steel alloyed chain
securing a floating deck
barge to a dolphin was hung up that would not allow the barge to be level
because the water
level was high. By the chain hanging up tension was created in that the
chain had to cut . By
cutting the chain with a torch it cause a sling shot reaction striking the
Plant Manager in the
back of his head resulting into his death:
(a)Falco Chemical- Employee was struck in the head by a steel alloyed
chain. The
steel chain was used to keep a floating deck barge secured to a dolphin.
The dolphin is
a structure that is driven into the river channel that has pins and shoes
that would slide
up or down a H-beam that would allow the barge to float according to the
rise
or
lowering of the water. The two inch heavy duty steel alloyed chain was
wrapped around
the dolphin and the plate on the barge with hooks connecting back into the
chain. The
water level was high creating tension on the chain. In order to level the
barge the chain
had to be cut. During the cutting of the chain a sling shot reaction was
created and struck
an employees in his head causing his death.
