Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, employees
were exposed to the hazard of a contact with a rotating saw blade:
(a) Production area - the Haberle cut off (cold) saw was not equipped with
a
magnetic restarter or similar device, as prescribed by the American
National
Standard for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that
in the
event of an interruption in the electrical supply, would prevent the saw
from
restarting automatically when power is restored.
(b) Production area - the Haberle cut off (cold) saw and the Dake Johnson
band
saw were not equipped with a disconnecting means where the operating handle
was capable of being locked in the open (off) position, as prescribed by
the
American National Standard for Metal Cutting Saws, ANSI B11.10-1990.

(c) Production area - the Delta Milwaukee band saw was equipped with an
unprotected , toggle-type, motor starter switch instead of a starter
located,
designed, constructed, interlocked, or guarded to protect against
unintended
operation, as prescribed by the American National Standard for Metal
Cutting
Saws, ANSI B11.101990, Section 5.2.3.1.
Abatement certification only is required for this item in accordance with
the
requirements of 29 CFR 1903.19(c).s
