Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that an employee was protected while working in a GENIE Z- 45/25J Aerial Lift from the following conditions: a.At the west side of the building, an employee painting the outside trim of a window frame, was not utilizing the required personal fall protection device, creating a fall hazard of approximately 20 feet. Reference: ANSI 92.5 - 1980 Boom-supported elevating work platform: Section 13.2.1 - The work platform shall be used only in accordance with the manufacturer's/owner's operating instructions and safety rules. Section 13.2.2 - (6) Check to see that all occupants' safety belts are on and properly attached. One feasible means of abatement is to make sure that the proper personal fall protection equipment required to do the job is provided and utilized.
