Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls of 10 to 16 feet while working/walking atop the
upper tiers of the storage
rack system without any means of fall protection:
a- 150 Raritan Center Parkway: Employee(s) installing a steel storage rack
system inside
the warehouse of a client (Expediters International) was walking/working
atop the upper
tiers of the racking without any protection against falling.  As such, the
rack functioned
as an elevated temporary work platform.  Feasible options for fall
protection include, but
are not necessarily limited to, working from the safety of a manlift
equipped with proper
guard railing; or use of personal fall arrest devices such harness and
retractable lifeline.
