North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)facility - where employees were allowed to stand in close proximity of and reach underneath hoisted loads (i.e., parts equipment) of an overhead hoist, a Lesson 1 ton, and appurtenance that was not part of a regular inspection schedule. Abatement note: One feasible and acceptable method is to include this hoist in the regular inspection schedule along with the other hoists and cranes at the facility.
