Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment which was free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to caught in-between hazards:
(a)McLane Western at 2100 East Highway, Longmont, Co. 80502:  On or before
12/6/02, the employer did not provide adequate ventilation in the
mechanical room to
exhaust an accumulation of refrigerant due to leaks or rupture of the
ammonia system.
One feasible abatement method, among others, is to adhere to requirements
set forth
in ASHRAE standard 15-2001 Sections 8.11.4 - 8.11.5, which specifies
airflow
requirements in mechanical rooms where refrigerant is stored.
In addition, Section 8.11.2.1 of the ASHRAE standard provides that, unless
the fan is
operated continuously, the fan should be actuated by detector located in
the
mechanical room.  If the fan is operated continuously, Section 8.12(h)
provides that
an alarm is required upon failure of the mechanical ventilation system.
The
employer's fan operates continuously, but does not have an alarm that
actuates upon
failure.
Furthermore, Section 8.12(i) provides that ventilation fans shall be on a
separate
electrical circuit and have a control switch located immediately outside
the mechanical
room door.  The employer's ventilation control is located inside the
mechanical room.
