North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to:[Reference Compressed Gas Association, Inc., Pamphlet P-1, Safe Handling of Compressed Gases in Containers] a)Facility, storage garage - full oxygen cylinders were not stored at least 20 feet from, or separated by a noncombustible barrier at least 5 feet high, having a fire-resistance rating of at least 1/2 hour, from flammables. Multiple cylinders were stored immediately adjacent to a metal storage locker (not an approved flammable storage locker) used for storing containers of gasoline, spray paints and other flammables. [Reference paragraphs 3.5.5 and 4.2.2] Facility, storage garage - Container storage areas were not prominently posted with the name of the gas stored (oxygen). [Reference paragraph 3.5.2] Among other methods, one feasible and acceptable abatement method to correct this hazard is to store full oxygen cylinders in a separate area, at least 20 feet from flammables, and prominently post the area with oxygen signs.
