Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Jobsite - On or about April 5, 2002, employees installed windows, about 26 feet above the ground, from the platform of a Terex TB60 self-propelled aerial lift. These employees did not use personal fall arrest systems when working from the aerial lift. Among other methods, one feasible and acceptable abatement method to correct this hazard includes wearing a harness and lanyard with the lanyard attached to the boom or basket of the aerial lift, as outlined in the American National Standard Institute safety standard for Boom-Supported Elevating Work Platforms (ANSI/SIA A92.5-1992).ed
