Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were being elevated up to 35 feet by a Genie DPL Super Series (Double
platform lift)
telescoping lift to remove, replace, and install stain glass and storm
windows at a Church in Rt.
127, Celine, Oh. Two of the outriggers were shorten 6-8 inches altering
the stability of the
equipment and exposing employees to a fall, struck-by, and collapse hazard
on or about
September 23, 2003.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to replace the modified feet with the original manufacturer's component,
as specified in the
Genie Operator's Manual, page 3 of Safety Rules, or to obtained
authorization by the
manufacturer before any modification to the equipment is made.
