Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a) Peavey Grain - Huron, Ohio:  On or about November 5, 2003, the employer
did not ensure
employees and other workers on the site using the manlift (employer #3352)
located in the
headhouse, who were exposed to a fall hazard of up to approximately 135
feet, were properly
trained to use the manlift.  Employees were using the manlift to access
various floors of the
grain elevator to perform work assignments.  Employees were permitted to
start and restart the
manlift, without notification to others on the lift, and those in the
vicinity of the lift, that they
were going to start or restart the manlift.
Among others a feasible means of abatement would be to allow the manlift
to
run continuously
and/or utilize radio communication to inform others working at the site
that the manlift will be
started or stopped.
