Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were riding in the bucket of the excavator. Norton & Ahrens Street jobsite - Employee was riding in the excavator bucket for access/egress into and out of the trench. The trench was approximately 10 feet deep. A feasible means of abatement would be to follow the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators; and: Never allow employees to enter the bucket of an excavator or any other similar equipment. NO CERTIFICATION OR DOCUMENTATION REQUIRED FOR THIS ITEM
