Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees.
a.  On or about September 3, 2002, at the above addressed jobsite, a
stressing jack and pump
which was not secured to a fixed object fell to a lower level and struck
an
employee.
Among feasible means of abatement would be to comply with the
Post-Tensioning Institute
Field Procedures Manual For Unbonded Single Strand Tendons. Chapter 6,
Section 6.3
Stressing the Tendons, explains that when stressing above ground level,
jacks and pumps
shall be secured to a fixed object by means of a safety line to prevent
equipment from being
thrown off the building should a tendon, equipment or hydraulic line fail
during stressing.
Also, Section 6.5 Safety Procedures, states that the pump and jack should
be securely tied to
a solid object when working at an elevated level.ed
