Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an electrical hazard:
a)Worksite: 75th & Baltimore, Kansas City, MO- Employees were in the
process
of installing new cable TV wiring on utility poles, supporting energized
overhead
power lines, without maintaining a 30" midspan clearance between the new
cable
TV wire and the energized secondary above it, as required by ANSI C-2,
National Electrical Safety Code, Rule 235C2b(1). Employees were exposed to
an
electrical hazard, in the event of the new cable TV wire and/or the
supporting
messenger cable would come into contact with the energized secondary power
line
in a location where the outer protective shell was deteriorated.
While ultimate responsibility for correcting the hazard rests with the
employer, given his/her
superior knowledge of the workplace, feasible and acceptable methods to
correct this hazard
include:
1)Allowing adequate sag when pulling in the new cable TV wiring, to allow a
minimum midspan clearance of 30" from the energized secondary overhead
power
lines.
Abatement certification is required for this violation (using the
CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating
that
abatement is complete must be included with your certification.  This
documentation may
include, but is not limited to, evidence of the purchase or repair of the
equipment, photographic
or video evidence of abatement, or other written records.
