employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to the following:
a.  On the site, the employer did not follow the Equipment Manufacturer's
Institute safety manual for
backhoe/loader operators which states that the bucket of the loader is
never to be used as a work
platform or personnel carrier.
