Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushed-by hazards:
McDonald's restaurant located at 632 South R.L. Thornton Frwy., Dallas,
Texas:
On or about July 23 and again on August 2, 2002, employees who used a Ford
backhoe,
at the construction site, were involved in rollover accidents while using
the equipment
on the site.  The employer did not ensure that backhoe was secured to
prevent
unauthorized use.
Among other methods, feasible means of abatement include, but are not
limited to :
The removal of the engine start switch key to prevent unauthorized
personnel
from
starting the engine when the operator leaves the equipment as required by
the
manufacture's operation and maintenance manual.
