Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Unload/Load Area - An employee operating a 3750 lb. Toyota forklift was not protected from falling by a seat belt, while moving products around the facility, on or about October 17, 2002. Hazard of being struck by or crushed by forklift.
