Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
a)The hazard of being crushed, amputation and falls while riding the
excavator bucket into
and out of the excavation.
A FEASIBLE AND ACCEPTABLE METHOD TO ABATE THIS HAZARD WOULD BE
TO PROVIDE SAFE ACCESS AND EGRESS FROM TRENCHES AND EXCAVATIONS,
DEVELOP A WORK RULE, TRAIN AND INSTRUCT EMPLOYEES NOT TO RIDE IN
THE EXCAVATOR BUCKET AT ANY TIME AND ENFORCE THAT RULE.
