Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that workers were exposed to a fall greater than 10 feet while ridding the forks of a JLG/Gradall rough terrain forklift and/or riding the load that was attached to the forks of the lift. Among other means, some feasible and acceptable abatement methods to correct these hazards are: 1.Only use forklifts to lift personnel if they are specifically designed by the manufacturer for such use. 2.If the manufacturer's design permits the use of their equipment to lift personnel, follow the requirements set forth in The American Society of Mechanical Engineers, ASME B56.6-2002 Safety Standard for Rough Terrain Forklift Trucks, Part II, Section 5.15 entitled Elevating Personnel & Part III, Section 8.24 entitled Platforms for Elevating Personnel. 3.Provide powered industrial truck operators training that meets the requirements of 29 CFR 1910.178(l). 4.Use proper ladders/stairways to gain access to upper levels.
