Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards:
a)On or about April 8, 2003, employees were exposed to fall hazards while
pruning
trees with no fall protection in place;
Among other methods, one feasible and acceptable method of correcting this
hazard is to
ensure that employees are provided fall protection when ascending trees.

employees were exposed to the hazard of falling debris:
a)On or about April 8, 2003, employees were exposed to hazards of being
struck by
falling branches while working below tree pruning operations.  No
communication
system had been established between the pruner and the ground crew to
notify the
employees on the ground of falling branches.
Among other methods, a feasible and acceptable method of correcting this
hazard is to ensure
that crews are trained in recognizing hazards and to establish
communication systems
accordingly.
