Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The
employer did not
furnish employment and a place of employment  which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that, employees
were exposed to struck by hazards where a cement slab was not supported
while employee
performed clean up activities:
a) On or about June 19, 2003, the employer did not ensure that employees
were protected
from injury in that, the cement slab retaining wall was not adequately
supported.
Among other methods, one feasible and acceptable abatement method to
correct this
hazardous condition would be not to cut the dowels and to brace the cement
slab so that it
can not fall.
